There are many federal and state consumer protection laws that prevent creditors from engaging in fraud or harassing conduct against debts. One of the most important federal laws on the issue of “debt collections” is the Fair Debt Collection Practices Act (“FDCPA”). The purpose of the FDCPA is to prevent abusive, deceptive, and unfair debt collection practices. The FDCPA, among other things, prevents creditors from using “false, deceptive, or misleading representation or means in connection with the collection of any debt[.]” There are many examples of this type of behavior, but they can include:

  • Contacting you at inappropriate times of the day
  • Threatening to have you arrested or take other legal action that is not possible
  • Contacting you after you have already informed the creditor that you do not want to be called
  • Attempting to collect on a debt that is barred by the statute of limitations or has been discharged in bankruptcy

Upon a finding that a creditor violated the FDCPA, a defendant is able to recover actual damages and attorney's fees, costs, and other related expenses in connection
